PERSONAL DATA PROTECTION (KVKK) INFORMATION NOTICE
GENERAL INFORMATION AND DEFINITIONS
This information notice (“Information Notice”) has been prepared by our company, SailGoTurkey, with its registered office in Bodrum, Muğla / Turkey and registered with MERSIS under number 925051342600018 (“Company”), as the data controller, in accordance with the Turkish Personal Data Protection Law No. 6698 (“KVKK”), in order to inform you regarding the processing of your personal data within the scope of the commercial relationship established with you and/or your membership on our website located at www.sailgoturkey.com (“Site”).
The defined terms used in this Information Notice shall have the meanings set out in the KVKK and the relevant legislation issued pursuant thereto. Some of the definitions are as follows:

Explicit consent: Freely given, specific and informed consent concerning a particular subject;

Personal data: Any information relating to an identified or identifiable natural person;

Processing of personal data: Any operation performed on personal data such as collection, recording, storage, preservation, alteration, reorganisation, disclosure, transfer, retrieval, classification, or prevention of use, whether by automated means or otherwise, provided it is part of a data recording system;

Data processor: A natural or legal person who processes personal data on behalf of the data controller;

Data recording system: A system where personal data is structured and processed according to specific criteria;

Data controller: The natural or legal person who determines the purposes and means of processing personal data and is responsible for the establishment and management of the data recording system.
CATEGORIES OF PERSONAL DATA TO BE PROCESSED
Unless explicitly stated otherwise, the term “personal data” within the scope of this Information Notice shall cover the following categories:

Category I: Identity and contact details (name, surname, phone number, e-mail address, residential address, date of birth, gender, profile photo, sailing licence, documents and permits related to boat operation, and any additional personal information shared in forms or “About” sections).

Category II: Membership information, user activity and financial data (membership details, member ID, dates and times of service usage, billing and payment records, reviews and comments).

Category III: Information identifying boat owners (in addition to Category I, includes details about the boat, name of the boat, boat specifications).

Category IV: Transaction security information (passwords).

Category V: Cookie records and other data generated or collected automatically or non-automatically during Site usage that do not fall under the other categories.
Special categories of personal data include race, ethnicity, political opinion, philosophical belief, religion, sect, appearance, association or trade union membership, health, sexual life, criminal records, biometric and genetic data. The Company does not collect or process such sensitive data and does not request it under any circumstances. Please refrain from sharing special category personal data in any form of communication with the Company.
PURPOSES OF PROCESSING PERSONAL DATA
The personal data specified above is processed in line with your use of the Site, the performance of contracts established with the Company, and within the scope of boat rental agreements, for purposes including:

Checking boat availability, making reservations, concluding and fulfilling rental agreements between boat owners and renters, and handling feedback or complaints;

Responding to your messages, calls or support requests;

Investigating user complaints and resolving them appropriately;

Reviewing your account on the Site and affiliated platforms in case of user-requested review or external complaints;

Maintaining financial records and reports for internal management;

Quality control and service improvement via satisfaction audits;

Analysing usage and updating business processes, improving current and future services, software and platforms;

Tracking user behaviour to provide personalised and efficient services, including promotional activities;

Providing support or information to potential and current boat owners or suppliers, domestically or internationally;

Managing relationships with business partners, suppliers, and boat owners;

Sending publications, reports, bulletins, promotions or updates, responding to member inquiries, conducting marketing research and surveys, and fulfilling legal obligations.
Additionally, your personal data may be processed:

To exercise or defend our legal rights during any legal or administrative process;

When legally required to share data with competent public institutions, courts or third parties;

In case of any contractual relationship formed between boat owners and renters through the Site, such parties may act as independent data controllers and shall be responsible for their own processing activities.
METHOD AND LEGAL BASIS FOR COLLECTING PERSONAL DATA
Your personal data is collected via the Site through online forms, email communications, social media platforms accessible to or authorised by us, phone calls with our support centre, postal or courier services, and, where applicable, face-to-face meetings.
Your data is processed on the legal grounds stated in Article 5 of the KVKK, including:

When required by law;

When necessary for the establishment or performance of a contract;

When necessary for fulfilling legal obligations;

When you have made your data public (to the extent compatible with that purpose);

When required to establish, exercise or defend legal claims;

When necessary for our legitimate interests, provided it does not harm your fundamental rights and freedoms.
TRANSFER OF PERSONAL DATA
Your personal data may be transferred domestically in accordance with Article 8 of the KVKK and internationally with your explicit consent in accordance with Article 9, to:

Our affiliates, shareholders, business partners;

Product and service providers;

Third-party software/hardware/cloud service providers and hosting companies;

Public authorities and authorised private entities.
Personal data of users wishing to rent a boat may be shared with the boat owner, and vice versa. Except for exemptions under KVKK Articles 5 and 6, data cannot be shared with third parties without explicit consent. Transfers abroad also require explicit consent unless an exemption under Article 9(2) applies.
DATA SUBJECT RIGHTS
In accordance with Article 11 of the KVKK, you may apply to our Company to:
a) Learn whether your personal data has been processed;
b) Request information regarding the processing of your personal data;
c) Learn the purpose of processing and whether it is used in accordance with that purpose;
ç) Learn the third parties to whom your personal data has been transferred domestically or abroad;
d) Request correction of inaccurate or incomplete data;
e) Request deletion or destruction of your data if the reasons for processing no longer apply;
f) Request notification of such correction or deletion to third parties to whom the data was transferred;
g) Object to any outcome arising from automatic processing;
ğ) Claim compensation for damages incurred due to unlawful processing.
You may exercise these rights by applying via registered mail, secure electronic signature, KEP address or your previously registered email address. The application must contain your full name, signature, ID or passport number (for foreign nationals), contact details and your request, along with any supporting documents.
The Company will respond within thirty days, free of charge for up to ten pages; for each additional page, a fee of 1 Turkish Lira may be charged.
